Planning permission - Subdivision

You want to develop a plot of land or create an allotment.

A subdivision is a division, in ownership or in possession, of a land unit - or of several contiguous land units - with the aim of separating one or more lots intended for building (article L 442-1 of the French town planning code).

There are two procedures for building a housing estate:

  • prior declaration (article R 421-23 of the town planning code)
  • planning permission (article R 421-19 of the town planning code).

The procedure depends on 2 alternative criteria:

  • the location of the project
  • the creation or development of roads, common spaces or facilities specific to the allotment. Subdivision providing for the creation or development of roads, common spaces or facilities specific to the subdivision.

Planning permission (art. R 421-19 Code de l'urbanisme) :

  • Subdivision located in a protected area, a classified site or a site awaiting classification
  • Subdivisions other than those mentioned above (e.g. division of a plot of land without shared roads, areas or facilities).
